MINUTES OF PLANNING AND ZONING MEETING

 

August 21, 2007 – 5:00 p.m.

I.                   CALL TO ORDER 

Vice Chairman Bob Croyle called the meeting of the Planning and Zoning Commision of the City of Bunker Hill Village to order at 5:08 p.m. in the Conference Room of City Hall, 11977 Memorial Drive, to consider the following:

II.             CONSIDERATION AND POSSIBLE ACTION REGARDING APPROVAL OF MINUTES OF THE FOLLOWING MEETINGS:

a.       August 6, 2007

b.      August 9, 2007 

Motion was made by Gary Orr and seconded by Jacki Lammert to approve the minutes of August 6, 2007 and August 9, 2007.  Motion carried 4 to 0. 

III.       JOINT PUBLIC HEARING WITH CITY COUNCIL REGARDING THE FOLLOWING PROPOSED AMENDMENT TO THE ZONING ORDINANCE: 

AN ORDINANCE AMENDING APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF BUNKER HILL VILLAGE, TEXAS, SAID APPENDIX A BEING THE ZONING ORDINANCE OF THE CITY, BY DELETING FROM ARTICLE V THEROF ALL OF SUBSECTION C OF SECTION 6.06 AND SUBSTITUTING THEREFOR A NEW SUBSECTION C OF SECTION 6.06: PROVIDING AN EXCEPTION TO ALLOW THE EXPANSION OF A MAIN BUILDING INTO A REQUIRED SIDE YARD PROVIDED SUCH EXPANSION DOES NOT ENCROACH NEARER TO THE SIDE LOT LINE THAN THE EXISTING MAIN BUILDING, BUT IN NO EVENT NEARER THAN FIVE (5) FROM A SIDE LOT LINE;  PROVIDING AN EXCEPTION TO ALLOW THE RECONSTRUCTION OF A VEHICULAR DRIVEWAY INTO A REQUIRED SIDE YARD GREEN SPACE PROVIDED SUCH RECONSTRUCTION DOES NOT ENCROACH NEARER TO THE SIDE LOT LINE THAN THE PREVIOUS DRIVEWAY, BUT IN NO EVENT NEARER THAN ONE (1) FOOT FROM THE SIDE LOT LINE; PROVIDING PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. 

(Excerpt from Council Minutes) Mayor Pro Tem Essary introduced Bob Croyle, Vice Chairman of the Planning and Zoning Commission and asked him to introduce the members present.  Vice Chairman Croyle introduced Cooky Mays, Gary Orr and Jacki Lammert.

 

Steve Smith briefly summarized the proposed amendment to the Zoning Ordinance.

 

Mayor Pro Tem Essary invited interested citizens to speak. 

 

No comments. 

IV.       CONSIDERATION AND POSSIBLE ACTION REGARDING RECOMMENDATION TO CITY COUNCIL REGARDING AMENDMENT PROPOSED IN ITEM III ABOVE. 

Motion was made by Gary Orr and seconded by Cooky Mays to recommend to Council to approve the Amendment proposed in Item III with minor clarification of Ordinance No. 07-361, Section C, paragraph 2: 

“ (2) Along side lot lines within a required front yard, a two and one-half foot wide green space shall be maintained.  Notwithstanding the foregoing, a vehicle driveway may be reconstructed with a required front yard green belt if the reconstructed driveway is located no nearer than (i) one (1) foot from the side lot line, or (ii) the distance between the preexisting driveway and the side lot line before reconstruction, whichever encroaches into the required green space the least.” 

And 

Ordinance No. 07-361, Section C, paragraph 4: 

“(4)  Notwithstanding the foregoing, the expansion of a main building into a required side yard shall be permitted if the expansion is located no nearer than (i) five feet (5’) from the side lot line, or (ii) the distance between the main building and side lot line before the expansion, whichever encroaches into the required side yard the least.”

With a vote of 4 “for” and 0 “against”, the request was approved.
