MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING THURSDAY, JANUARY 28, 2010 5:30 P.M. Chairman Bill Purifoy called the meeting to order at 5:30 p.m. in the City Hall Council Chambers, located at 11977 Memorial Drive, Houston, Texas.

1. DISCUSSION AND POSSIBLE ACTION REGARDING MINUTES OF SEPTEMBER 22, 2009 Motion was made by Al Augustine and seconded by Gerald Teel to approve the minutes of September 22, 2009 as submitted. Motion carried 5-0. II. DISCUSSION AND POSSIBLE ACTION REGARDING AN ORDINANCE OF THE CITY OF BUNKER HILL VILLAGE, TEXAS, AMENDING APPENDIX “A” OF THE CODE OF ORDINANCES OF THE CITY, SAME BEING THE COMPREHENSIVE ZONING ORDINANCE OF SAID CITY, BY GRANTING A SPECIFIC USE PERMIT FOR CONSTRUCTION AND USE OF ADDITIONAL BUILDINGS AND/OR STRUCTURES TO BE CONSTRUCTED BY CLEARWIRE CORPORATION AND TO BE LOCATED AT 11977 MEMORIAL DRIVE, HOUSTON, TEXAS, TO WIT: TELECOMMUNICATIONS FACILITIES, AND OTHER INCIDENTAL IMPROVEMENTS; PROVIDING FOR REPEAL; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. This item was not discussed and no actions taken at the request of R. Brandon Bundren, Attorney representing the Pascouets who live near the specific use site at 12014 Chatham.
III. DISCUSSION AND POSSIBLE ACTION REGARDING AN ORDINANCE AMENDING APPENDIX “A” OF THE CODE OF ORDINANCES OF THE CITY OF BUNKER HILL VILLAGE, TEXAS, SAID APPENDIX “A” BEING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY, AS AMENDED, BY AMENDING SECTIONS 9.05D, 9.07B, AND 9.08, OF ARTICLE IX, NONCONFORMING USES, TO CLARIFY METHOD OF CALCULATING THE APPRAISED VALUE OF A STRUCTURE IN THE EVENT A BUILDING IS PARTIALLY DESTROYED; AMENDING REGULATIONS CONCERNING THE
REPAIR AND MAINTENANCE OF NONCONFORMING BUILDINGS OR STRUCTURES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY.
Chairman Purifoy invited comments from the audience.
Wm. J. A. Smith, spoke on behalf of his son Stephen Smith, 234 Plantation, who has been involved in obtaining a permit to remodel his house. Mr. Smith said that because of the restrictions placed on remodel projects it appears the city wants the older homes to be torn down.
Amy Smith said that the current ordinance regarding remodel projects has the “meanest restrictions” that she has ever seen.
Stephen Smith, 234 Plantation, objected to the current requirements that state if a remodel project exceeds 50% of the valuation on the Harris County Appraisal District roll at the time of construction, the project would need to be brought up to current building code and zoning ordinance.
Motion was made by Gary Orr and seconded by Al Augustine to decline the proposed ordinance. After discussion, the motion was withdrawn by Gary Orr and the second was withdrawn by Al Augustine.
Motion was made by Gary Orr and seconded by Al Augustine to table the proposed ordinance for further evaluation and modification that removes the concept of using appraisal, and opts for the concept of replacement for construction cost. Al Augustine seconded the motion. Motion carried 6-0.
IV. ADJOURN Motion was made by Gary Orr and seconded by Gerald Teel to adjourn the meeting at 6:50 p.m. Motion carried 5-0.
